Chief Justice writes to President Mahama, requesting petitions seeking her removal

Chief Justice Gertrude Torkonoo has formally written to President John Dramani Mahama, requesting copies of petitions filed against her that seek her removal from office.

In her letter, Chief Justice Torkonoo cited audi alteram partem rule of natural justice, and fundamental human rights of citizens under article 19, article 23 and article 296 of he 1992 constitution, and all decisions in Ghana’s jurispudent.

“I am by this letter humbly and respectfully asking His Excellency the President and eminent members of the Council of State to forward the petitions against me to me and allow me at least seven days after receipt of the same to provide my response to you, which response can then form part of the materials that you conduct the consultation anticipated under 146(6), before the possible setting up of a Committee of Inquiry under article 146(7),” part of the letter stated.

Madam, Gertrude Torkonoo request comes after the president, H,E. John Mahama received three petitions demanding the removal of the Chief Justice from office.

Mr. Mahama had since forwarded the petitions to the Council of State for advice, in line with Article 146 of the 1992 Constitution.

The Council of State is expected to review the petitions and provide guidance to the President on the appropriate course of action.
